Terms & Conditions

We expect you to follow our terms & conditions and in return we will provide the best services we can. 

 

Formation

The contract is formed when the customer completes their payment and booking through Shopify. The equipment for hire will remain in Momentous Event Hires ownership during the duration of hire. 

Momentous Event Hire reserves the rights to change the Terms and Conditions at any given time. The terms applicable will be the ones on the website at the time of pickup. 

 

Payment

Full payment is required at time of booking. The Customer shall make payment through the website to complete their booking otherwise their booking will not be confirmed.

Payment for extra fees will be due 7 days after the breach of contract happened. The customer will be invoiced for this amount. If the amount is not paid within 7 days, 10% interest will be added every 7 days. 

 

Pickup

All items will be ready for pickup by the time stated on Pickup/Drop Off section on the item unless otherwise arranged. 

 

Drop Off

The equipment must be returned to by the time stated on Pickup/Drop Off section on the item unless otherwise agreed. If the hirer returns outside of this agreed date/time the customer will be charged of a late fee in line with the fees below.

 

Delivery

Momentous shall deliver the equipment to the location set out in the order or such other location as the parties may agree at the agreed time at the specified agreed cost. This has to be agreed to with Momentous Event Hire prior to booking.

 

Damage

The Customer shall give Momentous immediate notice in the event the equipment is lost, stolen or damaged as a result of the Customer’s possession or use of the equipment or if there is a claim or, for any reason, a threat of seizure of the equipment.

In the event the equipment get damaged or stolen, the customer must pay the full cost to replace or repair the equipment. This cost may fluctuate depending on the price of the raw materials at the time and the labour time involved. The RRP at the time of damage will be used. 

 

Liability

In the event that an injury or or death is caused by own negligence, Momentous shall not be held responsible.

 

Obligations of the Customer

The customer shall, during the term of the contract at its expense and at all times during the Rental Period, keep and maintain the equipment in good and substantial repair, condition and appearance in order to keep it in as good an operating condition as it was on the commencement date of the Contract (only fair wear and tear accepted).

 

During the term of the contract all equipment are only used for the purposes for which it was designed and operate in a careful, prudent manner and in accordance with the instructions for use. The hirer must act with reasonable care. 

  

Cancellation/Refund

In the event the customer does not want to hire the equipment, the customer must give at least 14 days notice and will be given a 100% refund, or store credit.

Cancellations falling outside the 14 day period will not be refunded. This is due to the potential of Momentous Event Hire not being able to refill the booking again with such short notice. 

If there are any concerns with the item at pickup, the hirer has the duty to make Momentous Event Hire aware and we will amend the situation. The hirer will have to give written notification within 2 hours of pickup in this instance. 

In the event the user cannot use the equipment (due to non self inflicted events) the customer will receive a full refund. This includes COVID lockdowns where events cannot go ahead, earthquakes, fires and other events of similar nature. 

 

Extra Fees

If the item is returned late the customer will be required to pay a late fee depending on the period of time

If the item is returned dirty, has extra items on it such as blue-tack or tape the customer will be required to pay a cleaning fee of $15. 

If the item is damaged, the customer must pay the full cost to replace or repair the equipment.

If the item is not returned they way it was sent out (e.g. not in its bag, returned with no bag, returned with no box, returned erected and not dismantled) the customer will be charged a fee of $20. The customer will be charged full cost to replace the bag, box or anything similar if it is not returned within 24 hours. 

If the instruction sheet is not returned with the item, there will be a fee of $5 to replace. 

If any items are taken that were not a part of the order then you will be charged for a full hire of that item and any loss to Momentous Event Hire.

If the hirers conduct results in any loss of profits by Momentous Event Hire from another customer e.g. Item cannot be hired out resulting in cancellations of hires due to damage or anything similar in nature; the hirer will be liable for that loss.

If in any circumstances the item has to be collected due to a failure to return there is a $50 fee for pickup. 

Photos

If any photos are posted with our items on social media we retain the right to repost these either on Facebook, Facebook Marketplace, Instagram or our Website unless otherwise expressed by the hirer.
